TERMS OF SERVICE & VIP CONTINUITY AGREEMENT

1. ACCEPTANCE OF TERMS Welcome to shopwaykind.com (the "Site"), operated by Quantum MS L.L.C. ("Company", "we", "us", or "our"). By accessing or using our Site, purchasing products, or enrolling in our continuity programs, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.

2. WAYKIND VIP CLUB: CONTINUOUS SERVICE AGREEMENT & AUTOMATIC RENEWAL PLEASE READ THIS SECTION CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR BILLING, AUTOMATIC RENEWAL, AND RECURRING CHARGES.

2.1. Enrollment & Authorization: By selecting the "VIP Price," "VIP Add to Cart," or any similarly designated subscription option at checkout, you affirmatively consent to enroll in the Waykind VIP Club. You explicitly authorize Quantum MS L.L.C. to initiate a continuous, recurring subscription using the payment method provided at checkout. 2.2. Billing Cycle & Fees: Upon enrollment, you will be charged an initial, non-refundable membership fee of $39.99, granting you 30 days of VIP access, exclusive benefits, and discounted product pricing. Exactly 30 days from your initial transaction, and every 30 days thereafter, your provided payment method will be automatically charged the recurring monthly membership fee of $39.99 until you expressly cancel your membership. 2.3. Billing Descriptor: Recurring charges will appear on your financial statement as WAYKIND*RETAIL or a substantially similar identifier. You agree that it is your responsibility to maintain a valid, unexpired payment method on file. 2.4. Cancellation Rights & Frictionless Exit: You maintain the absolute right to cancel your continuous membership at any time, for any reason, with zero termination fees. To avoid the next recurring charge, cancellation requests must be processed at least 24 hours prior to your scheduled billing date. 2.5. Methods of Cancellation: You may cancel your subscription 24/7 via our automated self-service portal located at cancel.shopwaykind.com. Alternatively, you may submit a written cancellation request to support@shopwaykind.com or contact our customer support center directly. Upon cancellation, you will retain your VIP benefits through the end of your current paid billing cycle.

3. RETURNS, REFUNDS, AND EXCHANGES 3.1. Physical Goods: We accept returns of unopened, unused physical merchandise in its original packaging within 30 days of the original purchase date. Customers are responsible for all return shipping costs unless the product arrived damaged. A refund for physical goods will be issued to the original payment method within 5-7 business days of our facility receiving and inspecting the returned merchandise. 3.2. Digital Services & Memberships: Due to the immediate delivery, digital nature, and instant access to discounted pricing provided by the Waykind VIP Club, all monthly membership fees are strictly non-refundable once processed. Cancellations apply to future billing cycles only. No prorated refunds will be issued for partial months.

4. INTELLECTUAL PROPERTY & PROPRIETARY RIGHTS All content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations is the property of Quantum MS L.L.C. or its content suppliers and protected by United States and international copyright laws. You may not systematically extract or utilize parts of the content without our express written consent.

5. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU ARE PROVIDED BY QUANTUM MS L.L.C. ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION. TO THE FULL EXTENT PERMISSIBLE BY LAW, QUANTUM MS L.L.C. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT SHALL QUANTUM MS L.L.C., ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF ANY SERVICE OR PRODUCT.

6. DISPUTE RESOLUTION: MANDATORY ARBITRATION AND CLASS ACTION WAIVER PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or your relationship with Quantum MS L.L.C., shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. You and Quantum MS L.L.C. agree that any legal proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

7. GOVERNING LAW These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

8. SEVERABILITY AND ENTIRE AGREEMENT If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. This agreement constitutes the entire agreement and understanding between you and us, superseding any prior or contemporaneous agreements, communications, and proposals.
